1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the WPDeveloperHub website at wpdeveloperhub.com and any services provided by WPDeveloperHub ("we", "us", "our"). By accessing our website or engaging our development services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use our website or services.
2. Services
WPDeveloperHub provides professional WordPress development services including but not limited to:
- Custom WordPress website design and development
- Custom plugin development and modification
- WooCommerce store setup and customization
- LMS (Learning Management System) platform development
- WordPress performance optimization and security hardening
- Ongoing maintenance, support, and hosting management
- Enterprise WordPress solutions and API integrations
The specific scope, deliverables, timeline, and pricing for each project are defined in a separate project agreement, proposal, or statement of work agreed upon by both parties before work begins.
3. Project Agreements & Scope
All project work is governed by a written project agreement or proposal. Any changes to the agreed scope of work ("scope creep") must be approved in writing by both parties and may result in additional charges and/or extended timelines.
We reserve the right to decline any project request at our sole discretion.
4. Payment Terms
Unless otherwise specified in the project agreement:
- A deposit (typically 50%) is required before project work commences
- The remaining balance is due upon project completion, prior to final delivery or site launch
- Invoices are due within 7 days of issue unless otherwise agreed
- Late payments may incur a 1.5% monthly interest charge on outstanding balances
- Work may be paused or withheld until overdue invoices are settled
All prices are in USD unless otherwise stated. Clients are responsible for any applicable taxes in their jurisdiction.
5. Intellectual Property
Upon receipt of full payment, ownership of the custom code and design assets created specifically for your project transfers to you.
The following remain the property of WPDeveloperHub or their respective owners:
- Third-party plugins, themes, and libraries used in the project (subject to their own licenses)
- Our proprietary frameworks, boilerplate code, tools, and internal development processes
- Any work product if payment is not received in full
You grant us permission to display your completed project in our portfolio and marketing materials unless you request otherwise in writing.
6. Client Responsibilities
To ensure timely project delivery, you agree to:
- Provide all required content, assets, credentials, and feedback within agreed timelines
- Have authority to use any content, images, or trademarks you provide to us
- Review and approve deliverables promptly — delays on your end may affect the project schedule
- Provide a staging/testing environment or access to your hosting where required
Delays caused by late client feedback or missing materials do not constitute a breach by WPDeveloperHub and may result in revised delivery timelines.
7. Revisions & Acceptance
The number of revision rounds included is specified in your project proposal. Additional revision rounds beyond the agreed scope will be billed at our standard hourly rate.
If no feedback is provided within 14 days of a deliverable being submitted for review, it will be considered accepted and the project will proceed to the next phase.
8. Confidentiality
Both parties agree to keep confidential any proprietary information, credentials, business strategies, or technical details shared during the course of the project. This obligation survives the termination of any project agreement.
We will never share your login credentials, source code, or project details with unauthorized third parties.
9. Warranties & Representations
We warrant that our work will be performed with reasonable skill and care, and that deliverables will materially conform to the agreed specifications.
We do not warrant that:
- Third-party plugins or services will remain compatible after updates by their respective developers
- The website will be free from all bugs or errors beyond the agreed testing scope
- Specific business outcomes (e.g., traffic, sales, rankings) will be achieved
10. Limitation of Liability
To the maximum extent permitted by applicable law, WPDeveloperHub's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to WPDeveloperHub in the 3 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
11. Cancellation & Refunds
Either party may terminate a project with 14 days' written notice. In the event of cancellation:
- You are responsible for payment for all work completed up to the cancellation date
- Deposits are non-refundable once project work has commenced
- Completed and approved deliverables are non-refundable
- If WPDeveloperHub cancels without cause, a pro-rata refund of any prepaid unused fees will be issued
12. Acceptable Use
You agree not to use our services or website to:
- Build products or services that are illegal, harmful, or infringe on others' rights
- Distribute malware, spam, or unauthorized advertising
- Violate any applicable local, national, or international laws or regulations
- Attempt to gain unauthorized access to any system, network, or data
Violation of this section may result in immediate termination of services without refund.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration.
14. Changes to These Terms
We reserve the right to update these Terms at any time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
For active project clients, material changes will be communicated via email.
